The Executor or Administrator of an estate and the Trustee of a trust all have a right to be compensated for the fair value of the services that they perform on behalf of the estate or trust. Frequently, these charges are on a percentage basis and they vary, from case to case, based upon the nature of the services provided and sophistication required to provide those services. Normally, the fees are determined in consultation with the attorney, to make sure that they are reasonable and will not be subsequently questioned by the Court or beneficiaries.
